Please read our conditions of hire

IN REGARD TO THE FOLLOWING TERMS & CONDITIONS SHIRES MARQUEES shall be referred to as "the Company" and the prospective client wishing to hire equipment or structures shall be referred to as "the hirer".

1 Company Conditions

The company will submit a written quotation which the hirer shall accept in writing; the absence of such written quotation of acceptance however shall not invalidate the contract, and all work quoted for and undertaken by, or goods hired from, the Company shall be subject to these terms and conditions and the hirer by authorizing or allowing work to proceed, or goods to be delivered, is deemed to have the contract and to have accepted these terms and conditions.

2 Event Site

Our charges are based upon the event site being of firm ground flat, level, capable of & with good easy access for motor transport, and that there no drains / pipes / cables. (gas, water, electricity etc) or other services are buried beneath the surface or otherwise concealed or overhead that can be damaged by entering or working on the site. Our charges do not include any making good or repair to damage to site. Special rates will be payable for the purchase of equipment / materials on sites not conforming to the above requirements or for the delivery of goods other than on ground level. The hirer shall provide the contractor with a plan showing the position in which the tents or equipment are to be erected or shall have a representative on site for that purpose and in the absence of both, the contractor having erected the tents or equipment where he thinks fit shall be deemed to have completed the contract. The company will advise and make relevant recommendations on fixings.

Under No circumstances will the company be made responsible or Liable if these recommendations are not met by the customer whether we hire / install on behalf of any other hirer The hirer will be responsible for any costs associated with the repair to unmarked/unidentified services and associated costs relating to their interruption resulting from not being identified to the company.

3 FORCE MAJEURE

Whilst every effort will be made by the company to carry out any order accepted, the full performance of it is subject to variation or cancellation by the Company consequent upon Act of God, War, Strikes, Riots, Lock Outs or other Labour disturbances, Fire, Flood, restrictions on the use of Transport, Fuel or Power, Shortage of material or transport or labour or any other cause beyond the control of the Company.

4 LIABILTY TO THIRD PARTIES

The Company will not be responsible for, and the Hirer will indemnify the Company against all claims for injury to persons or loss of damage, to property, howsoever caused unless it be proved that such injury or damage be caused by faulty materials or workmanship or negligence on the part of the Company

The Company will not accept Liability and you may be liable for part/full hire fee:

A When the marquee build is delayed or cancelled due to the site being inaccessible or ill prepared or in any instance where the site is deemed unsafe by Company representatives.

B Delay or cancellation due to adverse weather conditions.

C Delay or cancellation due to the hirer not obtaining appropriate permission from the public or local authority.d When water ballasts are used, any delay or cancellation due to no suitable water source being available. Suitable sources include a hydrant or fast flow mains supply. Household or domestic taps are not suitable.

D Public/Product Liability £5,000,000

5 HIRE CHARGES AND PAYMENT

Whilst we endeavour to provide a competitive quotation to include costs for labour transport should any increases take place before or during the period of hire, outside of the Company’s control that were not foreseeable at the time of the booking the company reserves the right to vary the quoted Hire charges in that event.

A non refundable deposit of 30% will be required to secure a booking / event date. The full balance is due to be paid 14 days prior to the day of delivery by Bacs. Cheques may be accepted in certain circumstances at the Company’s discretion up £1,000.00 a deposit of 30% by cheque must be paid on booking and the remaining balance paid 14days minimum to the event. The cheques must be cleared prior to th event or it will be considered cancelled and the deposit forfeit. The Hirer shall pay the Hire charges and VAT on receipt of the company’s Invoice. The company reserve the right to treat non payment of any amount due as notice of cancellation by the hirer, in which case the Company will not supply the hired Equipment No receipt will be recognized unless on the Company’s official stationery.

The Company reserves the right to charge interest on overdue monies at the rate of 8% per annum above the bank base rate and varied from time to time. An administration fee of £50 per month is payable on all outstanding debt until paid in full. If the Customer defaults on payment the Company reserves the right to place the matter in the hands of their debt recovery agents, without prior warning in writing, and shall be entitled to a full reimbursement of any fees or disbursements paid to the debt recovery agent to aid recovery of monies outstanding to the Company.

6 DAMAGE

Any equipment found damaged or missing during the hire period will be repaired or replaced at the hirer's expense. No items or objects should be stuck to, fixed to, or suspended from the marquee sides, roofs or framework. If tape is used anywhere on the marquee structure a minimum charge of £50 will be levied for cleaning any residue.

7 MODIFICATION OF CONTRACT

No verbal representations or arrangements are recognized by the Company and these terms and conditions shall only be modified by a supplementary written contract.

8 HIRERS RESPONSIBILITY

The hirer is responsible for signing a completed safety checklist after consultation with a company representative once the marquee has been installed and in signing this checklist agree to abide by any instructions therein.

If the hirer is not present to sign the safety checklist two company representatives will do this on their behalf and a copy will be left for the hirer's reference.

The hirer shall not use cooking equipment, lighting or electrical appliances or decorate the interior/exterior of the marquee without prior consent from the company. Any damage/soiling resulting in such use that may require repair or cleaning will be charged to the hirer.

9 END OF HIRE PERIOD

The Hirer will be responsible for clearing the hired equipment of all rubbish, mess, broken glass and Third Party equipment, and leave readily accessible for dismantling and loading. The Hirer will indemnify the company for all costs, including loss of revenue, arising from the Hirers failure to comply with this condition.

10 NON AVAILABILITY OF SUPPLY

If for any reasons beyond our control any item of equipment booked is not available for the period of hire, we reserve the right to substitute an alternative size of marquee or other equipment to meet, as near as possible, your requirements. If we do so you will not have any claim against us. In the event that we cannot substitute suitable alternative sizes of equipment we shall notify you of cancellation of the contract in which event any deposit or other monies paid by you will be refunded immediately, but otherwise no claim shall lie against us.

Hire goods provided by Shires Marquee may in certain circumstances differ slightly from the photo images shown on our website, although every effort will be made to provide the goods as displayed in photo form on our website. We reserve the right to substitute articles of a similar nature.

11 OWNERSHIP

All equipment hired remains at all times the sole property of Shires Marquee. You may not sub-hire or part with possession of the equipment and you may not allow any lien or encumbrance to be created over the equipment.

12 EMERGENCY CALLOUT

Should an emergency call out of Shires Marquee staff be made this will be charges at such rates as Shires Marquee require with regard to the time and nature of the call out and Shires Marquee necessary expenses in dealing with the call out except here such an emergency is caused by defective materials or ShiresMarquees negligence.

13 CANCELLATION BY CUSTOMER

In the event the Hirer needs to cancel their order they must contact the company on Mobile 07967 183447 & confirm by email will be required. You will appreciate once you confirm your order & pay the deposit your event date and the required equipment / labour / transport is committed to your event. The company may have more than one installation on that day which will not affect your event.

The Hirer shall be entitled to cancel part or the whole contract on giving the Company notice in email on enquiries@shiresmarquees.co.uk.in accordance with the time limits subject to paying the Company such cancellation fees as specified:

A Cancellation of order within three months of booking the order / contract start date – Loss of deposit

B Cancellation of order between three months or more prior of booking the order / contract start date – 50% of booking value

C Cancellation of order up to one month prior to delivery – 100% of booking value
